Texas AG Sues Biden Over Billions For Trying To Expand Medicaid (Instead Of Tackling The Border Crisis)

Texas Attorney General Ken Paxton recently slapped the Biden Administration with a lawsuit after they tried to make changes to the state’s federally funded portion of Medicaid last month. The Biden Administration recently rescinded a Trump-era extension to the 1115 waiver agreement which would provide Texas’ uninsured residents with billions of dollars in federal funds.

The Trump-granted extension would’ve continued funding for hospital reimbursements through 2030 for the “uncompensated care” provided to uninsured individuals. It was helping states coping with their expanding Medicaid programs under the Affordable Care Act or “Obamacare.”

The 1115 waiver agreement is up for review every few years and renegotiates a new extension beyond its current expiration date. Even though the Supreme Court ruled in 2012 that they could not require states to expand their programs, there are always political strategies to force states like Texas into doing just that.

Nothing like Big Government trying to force states into expanding their Medicaid programs under the federal healthcare plan. Biden has already pushed billions of dollars In federal incentives to encourage Texas lawmakers to expand their Medicaid under the Affordable Care Act of 2010. Now it’s his way or no way.

“The Biden Administration cannot simply breach a contract and topple Texas’s Medicaid system without warning. Not only does this violate agency regulations and threaten to rip a $30 billion hole in Texas’s budget, but it was also clearly intended to force our state into inefficiently expanding Medicaid under the Patient Protection and Affordable Care Act (ACA). This would be a disaster for our state, and yet President Biden seems intent on thrusting his bloated model of government on everyone—including Texas,” the Texas attorney general said.

Paxton said it would force Texas back to the drawing board on negotiations over the extension and threaten to destabilize the programs the state funds through the waiver. Federal officials said that they could go through the full federal rule-making process and reapply in 2022, once the waiver extension expires. Paxton said it would prevent stable funding for healthcare providers with children, people with disabilities, and the elderly.

Texas officials are also looking to sue Biden over his “open-border” policies and unlawful entry. Democratic Texas Mayor Bruno Lozano told Fox News from what he’s been seeing, along with countless other border mayors and officials, that the southern U.S border currently looks like “an open floodgate for illegal immigrants.” Despite the Department of Homeland Security Alejandros Mayorkas claiming that the border is closed, numbers continue to fly in the other direction.

Mayor Lozana said he has repeatedly contacted the Biden Administration for help but has been told that the situation was “under control.” “I would very much disagree with that statement. The way that it’s been handling or being managed—it seems to be wide open for unlawful entry into the United States,” Lozano said.

Texas Sheriff Brad Coe also shared that they have seen a vast number of human smuggling events happening at the border and growing expenses from property damage caused by the mass influx of illegal immigrants. He said police have been stretched to their limits from the increase of calls and that they can no longer sustain the situation.


Meanwhile, Biden and Vice President Kamala Harris are too busy trying to expand Medicaid than to find an hour or two out of their schedule for a quick trip to the border to demonstrate expected leadership. They owe it to the American public that they’re paying attention and, so far, they’ve only shown how much they don’t care at all.
